Harvey Weinstein’s rape and sexual assault trial was scheduled to recommence on November 12 by a judge on Friday.
Since Weinstein’s 2020 rape conviction was overturned by the New York Court of Appeals, prosecutors have been getting ready to prosecute him.
Attorneys plan to offer fresh proof against Weinstein.
A jury found Weinstein guilty of raping an actress in New York in 2013 and compelling a former production assistant to have oral sex with him in 2006. As a result, Weinstein was sentenced to 23 years in prison.
The state’s top court determined that by permitting prosecutors to introduce witnesses whose accusations were unrelated to the charges against him, the trial judge had erred in law.
Following the agreement of additional women to testify against the embattled film mogul, prosecutors announced during Weinstein’s most recent court appearance on July 9 that they are pursuing a new indictment and plan to provide fresh evidence to a grand jury.
A Microsoft problem postpones Weinstein’s court date.
After more than ninety minutes, Weinstein made a brief appearance in court. The judge explained that the reason for the delay was the widespread Microsoft outage brought on by a CrowdStrike upgrade.
“Our technology and software analysts are hard at work assessing the Unified Court System’s digital networks and infrastructure to try to diagnose the potential impacts and deliver solutions to the widespread Microsoft outage issues that have emerged today. While no significant disruptions to in-person, courthouse operations are being confronted so far, our technology professionals are still in the preliminary stages of their work to assist staff around the state with disrupted interactivity issues. The Court, and its employees, are working collaboratively with all stakeholders through this crisis and remain committed to ensuring the highest levels of justice delivery and access to our judiciary system across New York State,” a spokesperson for the New York Office of Court Administration stated.

Because Weinstein was found guilty of rape in Los Angeles in 2022, he has remained incarcerated. He insists that every interaction was voluntary.
