A Lake in the Hills man who was accused of injuring a 5-year-old child by striking him in the face and body with a shoe was freed by a judge.
Vincente Cerqueda-Cortes, 48, of Lake in the Hills, was accused of two charges of domestic battery and aggravated battery to a minor.
According to a criminal complaint submitted to the McHenry County Circuit Court, on October 16, Cerqueda-Cortes allegedly injured a kid at Lake in the Hills.
According to the lawsuit, Cerqueda-Cortes hit a 5-year-old in the face, back, and both arms with a gym sneaker.
According to the complaint, the child, a member of Cerqueda-Cortes’ family, was bruised and red.
Cerqueda-Cortes was arrested the same day an arrest warrant was filed for him on Thursday.
Cerqueda-Cortes is a real and present threat to others, according to the McHenry County State’s Attorney’s Office, which filed a motion to hold him pending trial.
The petition was refused by McHenry County Judge Carl Metz after an Initial Appearance Court hearing.
As a condition of his parole, Metz mandated that Cerqueda-Cortes refrain from owning guns and from communicating with his underage children.
On December 5, Cerqueda-Cortes is expected to make another court appearance for a preliminary hearing.
