New Chapter in Rust Case Armorer Pushes for Retrial Post Baldwin's Dismissal

In response to Alec Baldwin’s surprising dismissal of his involuntary manslaughter charge last week, Hannah Gutierrez Reed filed an accelerated request for a new trial or to dismiss her case on Tuesday.

“Following the Baldwin trial and the dismissal with prejudice, Ms. Gutierrez-Reed intends to file an expedited motion for new trial or for dismissal for discovery violations and under the court’s inherent power,” according to the documents.

“Baldwin’s trial exposes extreme misconduct,” according to her attorneys, and “Special Prosecutor Kari Morrissey lies to this court under oath.”

In relation to the murder of cinematographer Halyna Hutchins in March, Reed was convicted guilty of involuntary manslaughter.

The gun on the Western movie set that shot live rounds belonged to the armorer. On October 21, 2021, actor Alec Baldwin drew a revolver from his holster, putting Hutchins in the line of fire.

Additionally, Gutierrez Reed was acquitted of the allegation of tampering with evidence, which was brought against her in 2023 after detectives said she had passed off a bag of cocaine the day of the deadly set shooting.

Alec Baldwin’s involuntary manslaughter case was dismissed by a Santa Fe court on Friday, July 12, on the grounds that the prosecution had withheld material from Baldwin’s attorneys.

The actor cannot be charged with the same offense twice, since Judge Mary Marlowe Sommer dismissed the case with prejudice.

“The state’s willful withholding of this information was intentional and deliberate,” Sommer stated. “If this conduct does not rise to the level of bad faith, it certainly comes so near to bad faith as to show signs of scorching prejudice.”

“There is no way for the court to right this wrong,” the judge continued.

The fact that Hannah’s defense team mentioned in their plea for a new trial was that “the same prosecutor and same sheriff’s office that handled the Gutierrez Reed case.”

According to papers, Baldwin’s trial included “new and different testimony that would have been critical to cross examination” of Seth Kenney, the owner of PDQ Props.

Additionally, the defense learned about “another possible 900 or so pages of material” pertaining to state witnesses that Baldwin’s legal team had received but had not yet shared with the defense.

Guiterrez Reed had asked for a fresh trial back in March. The prosecution’s main focus during Gutierrez Reed’s trial was on her actions as an armorer, with the assertion that she performed her duties improperly.

Jason Bowles, her lawyer, countered that the deadly shooting was caused by uncontrollable circumstances that happened on the set.

“Whoever put the live round on set and then Mr. Baldwin, in the end, going off script and doing what he did,” the lawyer stated. “Those are outside events outside of Ms. Gutierrez Reed’s control that she didn’t know was going to happen.”
