Police in Fremont say a person has been detained on suspicion of driving under the influence after a vehicle struck and killed a jogger on Sunday.
Officers were dispatched to Mission Boulevard and Nursery Avenue at approximately 8:40 p.m. in response to a complaint of a person lying in the road. When first responders arrived, they pronounced the victim dead.
According to police, the victim was a jogger who was hit by a car that was heading north on Mission; the car impacted the east curb line first, then the pedestrian.
According to reports, 29-year-old Brian Gutierrez, the suspect, left the area on foot. During a phone conversation, Gutierrez “ultimately agreed to turn himself in,” according to Fremont police. A moment later, he was taken into custody.
Police suspect Gutierrez was driving too fast and under the influence of alcohol based on the early investigation. On suspicion of causing injuries in a hit-and-run accident and driving while intoxicated, he was taken into custody.

When the inquiry is over, further accusations, according to the police, will probably surface. There has been no announcement regarding the jogger’s identification.
Authorities said that this is the seventh deadly traffic crash in Fremont in 2024.
