An 18-year-old mother from Texas was detained after it was reported that she stuffed her newborn baby into a trash bag and threw it in the dumpster. She told police that she felt compelled to do this because she thought it would prevent her boyfriend from breaking up with her.

According to court documents, Everilda Cux-Ajtzalam was arrested on Thursday and charged with one count of felony abandoning a kid with no intention of returning.

Cux-Ajtzalam is accused of giving birth “on the ground behind the food truck where she works” and then taking the infant, who is identified in the documents as “John Doe” or “CW,” putting him in “a tied garbage bag,” and dropping him in a dumpster in the 6000 block of Dashwood Drive in Houston, Texas, according to a criminal complaint filed in the District Court for Harris County on July 21, 2024.

A magistrate judge noted in a bond order that contained a brief account of what happened, “(Defendant) put the child, placenta, and umbilical cord into a trash bag, took the trash bag to a dumpster, & left the child in the dumpster tied inside the trash bag.”

Later, someone heard the baby sobbing as they were passing the dumpster and dialed 911. When emergency responders and Houston Police Department officers arrived on the scene at 1:15 p.m., they were able to retrieve the toddler from inside the dumpster.

The sufferer was taken by Houston Fire Department medics to Texas Children’s Hospital so that they may receive care.

The infant was stable and in good condition, according to the authorities. He was given treatment before being given over to Child Protective Services.

The infant and the food truck were promptly linked by the police, who then located Cux-Ajtzalam. According to the bond order, Cux-Ajtzalam told officers that she “had no choice” but to throw the baby in the trash because “she didn’t want her boyfriend to break up with her.” The “event” was also allegedly captured on surveillance camera footage.

According to the Houston Chronicle, Cux-Ajtzalam, a native of Guatemala, appeared in court for the first time on Friday. Judge Veronica M. Nelson of Harris County District Court chastised her for abandoning her kid to perish in a pile of trash.

“It was pure luck that the child was found and received care,” Nelson reportedly stated. “Given the fact that it’s the middle of summer in Houston, Texas, and the temperature at the time noting the danger to the child; under those circumstances, I’m going to set the bail in this case at $90,000.”

According to court documents, Cux-Ajtzalam’s public defender asked for a bond of $7,500 while the prosecution wanted a bond of $150,000.

Despite the fact that Cux-Ajtzalam’s bond was eventually set at $90,000, documents indicate that Immigration and Customs Enforcement (ICE) has put a hold on her release. She is expected to appear in court on Monday and is presently being held at the Harris County Jail.
