A second-grade teacher in Northern California who the police claimed was instructing students with blood alcohol content levels twice the legal limit to drive will not face charges.
An employee of the teacher at Nuestro Elementary in Live Oak, an hour north of Sacramento, claimed that she appeared to be intoxicated, leading to the teacher’s arrest on October 2 for DUI and endangering the welfare of a child, according to the authorities.
Although she was placed in jail and an investigation was started, Sutter County District Attorney Jennifer Dupré announced on Monday that her office had decided not to press charges.
“It is not illegal to teach drunk,” Dupré stated, as per CBS Sacramento affiliate KOVR.
That day, the instructor took a car to school. Her blood alcohol concentration was nearly double the legal limit of.08%, according to deputies, and she failed a field sobriety test about two hours after they had first been in touch with her. Prosecutors, however, claimed they were unable to show she drove while intoxicated.
“During the investigation, it could not be established that Munson was under the influence when she drove to the school, as opposed to drinking only after arriving there,” Dupré stated in a Facebook post. “Additionally, the requirements for child endangerment cannot be met, as there was no specific information indicating that the children in Munson’s class were placed in a position where their persons or health were endangered. The mere potential that a situation could arise is insufficient to meet the requirements under the law. While the District Attorney’s Office agrees that it is highly inappropriate to teach while intoxicated, it is, unfortunately, not illegal.”
The district attorney further stated that the district’s choice about the teacher’s employment is unaffected by their stance on criminal charges.
A request for information from Law&Crime regarding the teacher’s status was not immediately answered by the superintendent or principal, Baljinder Dhillon. The district website does not have her listed as a teacher.

Due to reports that one of the staff members was acting incoherently, police enforcement was summoned to the school in the morning of October 2, 2023. The employee was swiftly removed off campus by law enforcement for processing, according to the letter.
