A Missouri woman who claims to have been soundly asleep in her bed was startled out of her reverie by a group of raccoons that fell from a broken ceiling. She is now suing her landlord in civil court to hold him liable for the raccoons’ attack.
Publicly available court records show that on August 16, Amanda Howery, of Kansas City, filed her petition for damages against SCI REI LLC and Sage Door Property Management LLC in the Jackson County Circuit Court. On August 19, SCI and Sage Door Property Management LLC received a formal summons.
Howery is requesting a minimum of $25,000 in compensation.
“While Plaintiff was asleep in her bed, multiple raccoons fell through the damaged ceiling and attacked Plaintiff causing injuries,” According to the complaint.
The woman claims that the “incident” at Howery’s rental property, which happened in February 2023, was caused by neglect to the property and included “an open hole in the roof, an unrepaired roof, compromised and/or damaged ceiling.”
Howery claims that “no reasonable person” residing in the apartment would have been able to anticipate this ceiling damage happening, and that she was unaware of the terrible conditions until the raccoons attacked her.
She claims the rental businesses “knew or should have known” the premises were dangerous, and she has filed two counts of negligence against them.
