During a dispute over line-cutting, a 33-year-old lady allegedly killed a 12-year-old girl, ruining the fun at a festival.

It took place at the West Side Nut Club Fall Festival in Evansville, Indiana, just before eight o’clock on Friday. While working security for the event, police investigators witnessed a fight break out between a lady who would eventually be identified as Kristin Burnett and another woman.

In a probable cause arrest affidavit, police stated that Burnett was unhappy that someone had cut in front of her while she was waiting in line for an amusement ride.

In front of the women, a 12-year-old girl chose to play peacekeeper and gave up her place in line during the altercation. She approached the defendant in a “non-threatening manner,” believing Burnett had not heard her, according to the affidavit.

According to a detective, “I observed Burnett grab [the victim] by the throat and forcibly push her against the gate of an amusement ride.”

To remove her off the girl, three policemen rushed to Burnett. According to the affidavit, Burnett was also restrained by a guy named Michael A. Flemming Jr. from the police officers attempting to arrest her. To let Burnett and Flemming know he was a police officer, the detective displayed his badge.

Detectives interviewed the victim after apprehending both. According to the complaint, she told police that her “breathing was restricted” after Burnett allegedly gripped her throat.

She was unable to feel her nose either. According to police, four additional witnesses supported the victim’s account and validated the investigators’ observations.

Burnett was taken to the Vanderburgh County Jail by police on suspicion of disorderly conduct and battery of a person under the age of 14. Since then, she has bonded out.

A police officer’s leg bled after Flemming took a “mule kick” at them while they were attempting to arrest him. According to 14news, he was taken into custody on suspicion of violence against a public safety agent, resisting law enforcement and causing bodily harm, and obstructing the administration of justice.

For more than a century, Evansville has hosted the event. When two West Side company owners made the decision to hold an event “for the betterment of the West Side of Evansville; also for the Betterment of Evansville as a whole,” it all started in 1921.
