A man who is thought to be a burglar is being charged with trying to kill a parking garage worker after both men were shot during a fight.
The NYPD is looking into what happened between alleged burglar Charles Rodie, 59, and parking garage worker Moussa Diarra, 57, both of whom live in Manhattan.
A police spokesperson confirmed in an email to UPI that shots were fired in front of the parking garage at 340 West 31st Street in Midtown Manhattan at about 5:30 a.m. on Saturday.
When the police got there, they found two men who had been shot.
Rodie had a small cut on his head, and Diarra was shot in the middle of his body. Both were taken to Bellevue Hospital, where their conditions were stable.
The New York Daily News said that when Diarra tried to talk to Rodie, Rodie pulled out a gun and fired four shots. Then, Diarra took Rodie’s gun and fired two shots at him. The gun was found at the scene of the crime.
The NYPD said that Rodie will be charged with trying to kill someone, assault, burglary, and illegally having a gun. Police said at first that Diarra would face charges, including attempted murder, but the Manhattan District Attorney’s Office later confirmed that it would not pursue charges “pending further investigation,” according to the New York Daily News.
As of Sunday, the Daily News said that the Manhattan District Attorney’s Office had not filed any charges in the case. Investigations are still going on.
